Aliette Hernandez Carolan

I made the decision in April 2026

From April 2004 to April 2026, I litigated complex marital and family law cases in Florida — twenty-two years inside the courthouse system, watching how it works and what it does to the people who have to use it. In April 2026, I made a decision. I closed the litigation side of my practice. Not as a step down, and not as semi-retirement. As a deliberate choice to do this work in a way that I think actually helps people.

My practice now is advisory only. I take on three kinds of engagements: consultations, presuit resolution, and Second Opinions. I do not appear in court. I do not represent clients of record in contested proceedings. If your situation requires that, I’ll refer you to a Florida litigator who does that work well — there are several I trust.

Why I changed how I practice

After 22 years, I had seen the pattern enough times. The cases that resolved well were almost always the ones where someone got smart, senior advice early — before positions hardened, before a filing forced everyone into adversarial postures, before the billing clock turned every conversation into a strategic calculation. The cases that resolved badly were almost always the ones where the legal process itself became the problem.

Litigation is the right tool for some matters. It is the wrong tool for many of the matters that end up there.

I built this practice for the second category. People who want a senior attorney’s read on their situation, who want to resolve things before they need representation in a courtroom, or who already have counsel and want an independent strategic check. The fee model matches that posture: flat fees, scoped engagements, no hourly clock running in the background.

How I work

Direct. I do not run a firm of associates. The senior attorney you book with is the senior attorney who reviews your matter, drafts your document, and signs the written work product.

Flat-fee. Every engagement is scoped and priced before you hire me. You know what it costs and what’s included.

Online. We meet by video. Documents move through secure electronic channels. There is no commute.

A note on the practice

I am one person, working independently. I am selective about the matters I take on. I tell prospective clients honestly when their situation isn’t a fit for what I do — that happens regularly, and it’s not a failure of the conversation. It’s the conversation working as intended.
